西藏自治区扎囊县人民陪审员制度现状研究

摘　　要：人民陪审员制度被视为西藏自治区实现司法民主的重要制度,西藏自治区人民陪审员制度能否实现司法民主,取决于该制度在具体的司法实践过程中能否发挥广大农牧民群众的作用。但是,西藏自治区的人民陪审员制度正处于初建阶段,存在着人民陪审员制度的认识和界定不够明确等问题,这极大限制了其功能的发挥。文章通过对西藏自治区扎囊县人民陪审员制度实施的现状进行调查研究,提出相应的改进建议,最终实现西藏自治区人民陪审员制度的司法民主价值。The people’s jury system is regarded as an important system of realizing judicial democracy in Tibet,the people’s jury system in Tibet autonomous region can realize the judicial democracy,depending on whether the system can play the role of the masses in the specific judicial practice. The relevant laws and policies on the role of the people’s jury system in Tibet in the judicial practice of the initial positioning,and give full play to their experience in the practice of non legal justice,the majority of farmers and herdsmen in the public thinking and the formation of professional legal thinking. However,the people’s jury system in Tibet is in the initial stage,so there is a problem that the people’s jury system’s understanding and definition is not clear,which greatly limits its function. So the Tibet Zhanang County People’s jury system for the implementation of the status of investigation and study,put forward the corresponding suggestions for improvement,and ultimately the Tibet people’s jury system of judicial democratic values.
