论电子数据原始性的证明机制

摘　　要：电子数据具有易复制性、挥发性、脆弱易逝性、较强的隐蔽性等特点,从而导致它的原始性很容易受到损坏,这样就大大降低了电子数据的证明力。所以在利用电子数据作为证据证明某个待证事实的过程中,如何证明其原始性就成为解决问题的关键。"电子数据的初始可视化形态"可以更好地解决电子数据原始性的问题。电子数据经电子设备处理形成可视化形式后的初始状态,与电子数据原件具有等价性和相同的证明价值。The electronic data bear the properties such as easily to be copied and to vanish. Volatility and elusiveness are also electronic data＇s features. All the properties contribute to the data＇s fragile originality, thus intensely impairing the electronic data＇s proving ability. During the proving process by using electronic data, the key to solve the problem is how to prove its originality. Electronic data＇s original and visible modality can better tackle the problem of electronic data＇s originality. After being processed by electronic equipments, the electronic data turn into visible primitive modality, which has the same value and proving function like original electronic data.
