大数据时代法学研究的新趋势

摘　　要：大数据时代数据的海量性、快速变化性、格式多样性和结构易变性的特征和数据的经济价值以及数据可以通过多种途径创造价值的作用对法学研究已经产生了不小的影响。这些影响表现为:出现法律空白或频繁出现新的法律纠纷;新的研究方法渗透至法学研究领域;开辟新的法学研究领域:数据权问题凸显;促进有关数据的学科与法学的融合。在大数据技术的影响下,法学研究的新趋势为法学研究的模式应重视团队合作研究,法学研究的对象应重视法与科技的关系,法学研究的领域应重视法学的跨学科研究和交叉学科研究。The characteristics of great volume,velocity of change,variety of formats,variability of data structures and economic values of data in the era of big data in company with the function of values creating by various means have exerted a significant effect on legal research. These effects are mainly as follows： legal blanks emerge or new types of legal disputes occur more and more frequently; new research methodology penetrates into legal research field; new legal research fields are explored： the prominence of data right; 4） the melting between data science and legal science is promoted. Affected by the big data technology,legal research tends to focus more on team work research. The subject of legal research shall pay more attention to the relationship between law and technology. The filed of legal research shall be extended to interdisciplinary research and overlapping disciplines research.
