多元纠纷解决机制中专业性人民调解发展路径研究--基于上海市医患纠纷人民调解工作实证分析

摘　　要：调解是现代社会解决争议的重要方式。在我国,人民调解制度作为一项具有深厚中华民族传统的法律制度,既是预防和化解民间纠纷的主要途径,也是促进基层治理、维系基层秩序的重要举措。然而,随着经济和社会的快速发展,社会矛盾呈现复杂化、多样化等特点,人民调解在化解行业、专业领域纠纷的过程中显得"力不从心"。因此,如何在新形势下继续发挥传统纠纷解决机制的资源和优势,提升化解行业、专业领域矛盾纠纷的能力,成为人民调解"创新完善"工作的重要课题和现实挑战。上海市在开展医患纠纷人民调解工作过程中,以促进政府治理和社会自我调节的良性互动为原则,加强政府的指导和支持,提升调解的规范性和专业性。本文拟从上海市医患纠纷人民调解工作出发,探讨多元纠纷解决机制中专业性人民调解的发展路径。Mediation is an important way to resolve disputes in modern society.In our country,the people＇s mediation is of deep Chinese tradition.It is not only the main way to prevent and resolve civil disputes,but also the important measure to promote the governance and maintain the basic order.However,with the rapid development of economy and society,social contradictions and disputes become more professional and complex,so that in the process of resolving professional disputes the people＇s mediation appears to be ＂inadequate＂.How to improve people＇s mediation ability to dissolve the professional conflicts and disputes,make it continue to play its advantage with existing profound resources under the new situation have become an important topic and practical challenge in the process of transformation and upgrading.
