摘 要:在传送带模式及专家模式理论下,行政权正当性来源于立法明确授权及行政机关本身拥有的人才与专业资源,使得法院主要审查环评审批是否符合法律规定,且在赋予行政自由裁量权的高度专业性质事务上采取自制的态度而尊重行政机关的决定。面对高度专业性的环评审批,立法授权无法遏止,科技理性招致质疑,唯有确保利益相关者的程序参与权,方可赋予行政决定实质正当性。面对行政权正当性理论的变化,法院亦应对环评审批司法审查原告资格的赋予及审查标准进行反思,恰当回应行政权从参与模式对程序理性及公民参与的追求来证成司法审查的正当性,同时实现对环评审批权的司法监督。Under the convey belt model and expert mode theory,executive legitimacy is from legislation mandate and the administrative authority itself having talent and professional resources,making the court mainly review the eia approval in accordance with the law,and in giving highly specialized nature of the administrative discretion affairs homemade attitude and respect the decision of the administrative organ. In the face of eia approval which is highly professional,legislation authorization cannot be contained,science rational is also questioned by people,only to ensure stakeholders' program participation,can give administrative decision substantive legitimacy. Due to the change of executive legitimacy theory,the court also should deal with the plaintiff qualification of judicial review and review standards on eia approval,and make appropriate response to the executive power from procedural rationality and citizen participation to pursuit the legitimacy of judicial review,at the same time,it will realize the judicial supervision on eia approval.
