摘　　要：作为社会系统中的调整机制,法治之美内生于主体—境遇—客体的动态结构以回应社会生活,具有规范性、合理性、合道德性的价值形态、生活形态与文化形态,外源于制度的生活化而具有真实性和导向性。认识风习视域下的法治之美,有助于展现法治的社会性、文化性和伦理性,避免陷入工具主义窠臼。As the adjustment mechanism in the social system, the beauty of rule by law responds to social life in a way of dynamic relation among the subject, situation and object.Which has regulatory, resonable and moral form of value, life and culture. The beauty of rule by law which embodies system in life also has factuality and directedness.To study on the beauty of rule by law in a view of social customs and habits, which can avoid instrumentalism and help to show the sociality, culture and ethicality of rule by law.
