摘  要:对于隐性就业歧视,现行反就业歧视法规制无力。然随着法治的推进,社会各个主体尤其是用人单位法律意识的增强,就业歧视会越来越多地以隐性形式出现。隐性就业歧视使得受到歧视的劳动者无法用现有的法律来维护自己正当的权益,致其社会不公感增强,直接损害了劳动者的个体权益。包容性的承认规则使道德规范成为软法变得可能,软法治理与隐性就业歧视的规则高度契合。软法治理具有开放性、协商性、参与性以及社会治理的灵活性,能充分调动政府、行业组织、基层自治组织、企业主体和劳动主体的民主参与,凝聚公共理性和各方共识,实现隐性就业歧视的有效治理。With regard to the discrimination of recessive employment, the current laws and regulations against employment discrimination are weak, but with the promotion of the rule of law, the employment discrimination will arise in recessive forms because the social main body especially the employing units increase the legal consciousness. The recessive employment discrimination makes the workers unable to safeguard their legitimate rights and interests, with established laws and the sense of social injustice of workers stronger, which directly damages the labors' rights and interests. Inclusive recognizing the rules makes ethics possible be soft laws. Soft law governance accords with the rules of recessive employment discrimination and has the characteristics of openness, consultation, participation and the flexibility of social governance, which can fully arouse the democratic participation of the government, trade organizations, the grass-root autonomous organizations, enterprise and entities and the laborers, agglomerate the public reason and the consensus of all parties and realize the effective governance of the discrimination of recessive employment.
