摘 要:劳务派遣公司以经营劳动力为特殊标的,既是中介又是当事人,其重要性和风险性不言而喻,因此虽为公司制,应不同于一般公司主体,应以特殊行业之特殊商主体为定位,对劳务派遣公司的设立人作出特别规制,以有利于劳务派遣机构良性经营、降低从业风险、维护劳务派遣工就业权益为原则,在设立人人数限制、设立人行为资格、劳动行政部门充当设立人等方面进行制度重构。As labor dispatch companies use labor as a special subject and have the dual nature of intermediary and party,they must be of high importance and face various risks.Therefore,such companies should be different from the general corporate,we should classify them as special business subjects in particular industry and make special provisions for the establishment of labor dispatch companies.In order to promote healthy operation,reduce business risks and maintenance dispatch workers' employment rights,it is necessary to reconstruct the system in terms of number limits of the settlor,behavior qualifications of the settlor and labor administrative departments acting as settler,etc.
