记者职务行为的竞业限制探析

摘　　要：当今媒体竞争异常激烈,原创内容是传统媒体对抗新媒体的重要砝码,而拥有专业记者队伍则是获得原创信息内容的重要保证;但少数记者热衷写外稿,或将重要素材、线索等提供给竞争对手,使本单位利益受损,因此实施记者职务行为的竞业限制确有现实必要。文章论证了记者竞业限制的法理依据,分析了竞业限制协议中双方的权利和义务边界,并将职务行为界定为使用单位配置的公共资源的行为,使竞业限制协议的签订更具操作性。Today the media competition is unusually fierce, and the original content is the important weight that the traditional media resist the new media. An important guarantee of getting the original information content is a professional team of journalists. But a few journalists are keen to write external draft, or will provide important news works, material, and clues to the competitors, which damages the interests of the unit. This is the practical necessity to restrict the duty behavior of the journalists. This paper demonstrates the legal basis of competition restricts about the journalist, analyzes the boundary both the rights and obligations of the competition restriction agreement and defines the duty behavior as the use of public resources allocation, in order to become more practical about the sign of the agreement.
