依法治国背景下美国法学教育对我国的启示与借鉴

摘　　要：美国的法学教育体系和教育模式被许多国家法学教育改革参考和借鉴。为了适应新时期社会发展的需求,培养为法律职业准备的法律人才,我国应当借鉴美国法学教育先进的经验,促进和提升法学教育的总体水平,及时调整和改进法学教育的教学模式,合理定位我国法学教育的目标;科学构建各种法学学位体系,加强法学院校的师资队伍建设,增加法学教育的投资力度;逐步改革法学教育的管理体制,加强法学院校的行业性管理;建立法学专业学生的综合素质审查制度,强调法律职业道德教育;为提高法学的职业化教育水平,发挥学生的学习积极性,应当施行司法考试与法学教育相衔接的教学模式。通过采取上述举措改革和完善我国的法学教育制度,培育优秀的法律职业人才,对全面推进依法治国方略具有非常重要的意义。American legal education system and education model are used for reference in legal education reform by many countries. As for China,in order to meet the demand for the new era development,and to train talents for legal profession,China should take reference from the advanced American experience of law education,promote the total level of legal education and reasonably locate the goal for China legal education;China should scientifically construct all legal degree systems,strengthen the teaching staff building at law school,and invest more in legal education; China should gradually reform the management system of legal education,strengthen the industrial management of law school; China should establish the law majors＇ overall quality review system,strengthen legal professional ethics education; in order to improve the level of the professional law education,and bring students＇ subjective initiatives into play,China should adopt the teaching mode connecting Law education with the judicial examination. By the measures above,reforming and perfecting China legal education system and train the excellent legal professional talents,it is significant for fully improving the ruling country by law strategy.
