摘 要:劳资私法自治根植于"劳动关系的善良风俗",并因符合劳动法秩序而获得合法性。劳动关系善良风俗的形成有赖于劳资力量的"对等"与国家理性的"回归"。如果要使劳资私法自治具有真实不虚的意义,需要一种能够维护劳动关系善良风俗的制度基础并将其转化为私法自治内容的巧妙的制度安排,即建立在集体劳动关系法与劳动基准法之上的劳资私法自治。在自成一体又动态发展的劳动法制度框架内,化解善良风俗与私法自治的冲突,形成内化于劳动法秩序,既"相克相生"又相辅相成的劳资合意制度。只有得到劳动关系道德基础的支撑,劳动法中的合意才有广阔的发展空间。在缺乏劳动关系善良风俗制度保障背景下,过早实施劳动法规制缓和是违背劳动关系治理规律的不明智举措。The labor- capital autonomy of private law takes root in the good custom of labor relation,and has been legitimized because it conforms to the order of the labor law. The formation of good custom of labor relation depends on the reciprocity of labor- capital power and the return of reason of state. To give practical significance to the labor- capital autonomy of private law,it is necessary to establish an ingenious institutional arrangement which can convert good customs to contents of autonomy of private law. The institutional arrangement should base on the collective labor relation law and labor standard law. In the institutional framework of labor law which has a style of its own and develops dynamically,the labor- capital autonomy of private law settles conflicts between good customs and autonomy of private law,and generates labor- capital consensus systems that conform to the order specified in the labor law. The consensus specified in the labor law could develop extensively only when supported by the moral foundation of labor relation. In the context of lacking safeguard of the good custom of labor relation,it is unwise to enforce labor law too early.
