摘　　要：道家思想是我国固有的传统文化,本文探讨道家思想与西方现代刑事法治理念的贯通。对老子思想中的"柔"与刑法谦抑精神,《易经》中的阴阳之道与两极化刑事政策思想,以及《道德经》中"和"与"俭"的观念与西方恢复性司法理念之间的契合展开研究,并将上述思想对我国刑事法治的现实影响展开探讨。Taoism is the inherent traditional culture in our country. This article explores the coincidence of Taoism and the concept of modern western criminal law. It researches on the coincidence between ＂柔＂ in Lao Zi＇s thought and the restraining spirit in criminal law, and Yin and Yang in The Book of Changes and the western polarized criminal policy ideas, and the ideas of ＂和＂and ＂俭＂ in Tao Te Ching and the western concept of restorative justice program. It also discusses the impact on the reality of the criminal law in our country.
