市民化能力、法律认知与农村宅基地流转——基于温州试验区的调查与实证

摘　　要：本文基于温州试验区502个农户的调查,从市民化能力和法律认知视角分析了农户宅基地流转行为。结果发现,随着个体收入中非农收入比例的提升,农户参与宅基地流转可能性加大。已经在城镇购买住房的农户有着更高的宅基地流转参与率。熟知法律流转规定的农户有着更高流转参与率。建议继续推动农村劳动力向非农业转移,增强其非农就业能力和获取收入能力;为进城农民提供价格适中、能够负担起的城镇住房;大力加强普法教育,引导宅基地流转市场规范运行。The residential land circulation can effectively improve land use efficiency,reduce waste of land resources and increase farmers' property income. Based on the survey of Wenzhou City,from the perspective of ability to achieve citizenship and cognitive ability in laws,we analysis farmer's residential land circulation behavior. The results show that:( 1) As the Nonagricultural income ratio improved,farmers may be more likely to involve in residential land circulation;( 2) Rural household income had no significant impact on the homestead transfer,but farmers who had buy houses in towns have a higher residential land participation rate.( 3) Farmers homestead transfer does not affect by their ownership cognitive.( 4) Farmers who are familiar with the provisions laws of circulation have a higher circulation turnover participation rate. In view of the above analysis,we put forward some corresponding proposals:First,we shall continue to transfer the rural labor force to non-agricultural industry,then,to enhance their employment ability and the ability to generate income. Moreover,the city government shall provide moderate price for farmers so that they are able to afford housing in cities and towns. To strengthen the law education vigorously,and to crack down the illegal land construction,and guide the land circulation market specification operation at the same time.
