海外代购食品质量安全法律监管问题探讨

摘　　要：通过对目前海外代购这一全新消费模式的现状分析与思考,提出海外代购食品安全法律监管存在的问题及原因,结合国外法律监管经验,提出相应建议与措施,以期为建立和完善海外代购食品安全法律监管提供参考。方法:搜索近年国内外研究海外代购食品及境外食品的相关文献及最新新闻报道实例,运用文献调查方法及比较分析法,分析海外代购食品安全风险、监管难度较大的问题和原因,以及国外对此类食品质量安全法律监管的良好经验。结果:海外代购食品质量安全法律监管存在六大问题及原因,建立和完善海外代购食品质量安全法律监管的六大建议及措施。结论:实现海外代购食品安全法律监管是解决食品质量与安全这一民生问题新的突破,食品质量安全法律监管将日趋完备。Through analyzing the current overseas online shopping pattern,this paper gave the safety problems and legal reasons of overseas online shopping food.Combining with foreign regulatory experience,this paper put forward suggestions and measures,with a view to establish and improve overseas food safety laws and regulatory reference.Authors searched for domestic and international research in recent years with overseas online shopping and foreign imported food relevant literature and the latest news instance.The paper used literature survey method and comparative literature analysis,and analyzed overseas food safety risk,regulatory difficult problems and causes.And it gives good foreign experience of such legal regulation of food quality and safety.The presence of six reasons and problems of overseas food safety legal and regulatory are given.Six recommend food quality and safety legislation and regulatory measures to establish and improve the overseas commodities safety legal system.The solution of livelihood issues-overseas food quality and safety supervision system was a new breakthrough.Imported food quality and safety legal regulation would become increasingly complete.
