摘　　要：美丽中国不能没有美丽乡村,绿色发展更不能缺少绿色农村。当前农村垃圾污染问题日益突出,严重影响着生态文明建设进程。因此有必要从预防和治理两个方面完善农村垃圾污染防治的法律法规,为农村垃圾污染问题的解决、美丽乡村以及生态文明建设提供法治保障。为解决农村垃圾污染防治法律制度的不完善、可操作性差的问题,需要转变观念,制定农村生态环境保护的综合性法律,完善地方立法,严格和强化法律责任等。同时还要提高农民的生态法治意识,奠定农村垃圾污染防治法制实施的群众基础。Beautiful China can not exist without beautiful villages just like the green countryside is part of the green development of green China.But currently the problem of rural garbage pollution has become increasingly prominent which seriously affects the construction of ecological civilization process.In order to solve the problem and guarantee the construction of ecological civilization for the beautiful country,it is urgent to take measures on the perfection of the prevention and control laws and regulations.However,there still exist some problems in law system aiming at preventing the rural garbage pollution at present.For the sake of getting the problems solved about the imperfect legal system of rural garbage pollution prevention and poor operability,it is needed to change the idea of legislation,lay down the comprehensive law of rural ecological environment protection,perfect the local legislation and strengthen the legal liability.At the same time,in order to lay the foundation for the implementation of the rural garbage pollution prevention and control law,it is necessary to improve the farmers’ awareness of the ecological law.
