失衡的司法鉴定执业环境及其治理

摘　　要：近年来,涉及司法鉴定的投诉、上访和闹鉴定现象频现,司法鉴定的执业环境处于失衡状态,导致鉴定活动的正常开展受到冲击。受此影响,鉴定活动已趋于过度保守状态甚至出现"选择性"受理情形,使鉴定的功能和作用明显减弱。从司法鉴定涉及的各种主体之权利、义务和利益关系进行梳理分析,学界理应从行业整体发展角度为司法鉴定执业环境的改善建言。In recent years,complaint,petition and requirement of authenticate relating judicial expertise frequently occurred,which leads to the unbalanced working environment of judicial expertise and negatively impact normal working procedure. Therefore,judicial appraiser tends to be conservative or even accepts cases selectively,thus the functions of expertise is obviously weakened. The present study analyzes the relating subjects＇ rights,obligations and interests, and put forward suggestions on how to improve the working environment.
