摘 要:传统教育行政权在高校章程的大规模制定"运动"中呈弥散之势,高校章程借此形势实现了基于学术自由和"去行政化"的权利扩张。从法学角度出发,朴素的宪政"制衡"思想、社会契约论及行政法上的限权理论,为高校章程的权利扩张和传统教育行政权的弥散提供了思想和制度支撑;而基于现实的、历史和经济的原因,二者分野也成为教育洪流发展的必然。"去行政化"背景下的高校自主章程的制度设计,应从宏观和中观两个层面出发,淡化传统教育行政权和强化高校自主权,以期实现"依法办学、自主管理、民主监督、社会参与"的中国特色高校制度。The traditional educational executive authority is fading away in the process of making charters of universities; and the charters of universities achieve the emerging of rights against administration on the basis of academic freedom. From the respective of jurisprudence, the plain constitutionalism idea of counterbalance, the social contract theory and the theory of limited right in administrative law offer the ideal and institutional support for the fading away and emerging.Because of the practical, historical and economic reasons, the dividing of them becomes the necessary e- ducational tendency. The strategies of making charters of universities in the background of against administration, from the macroscopical and mesoscopical level, desalts the traditional educational executive authority and reinforces the liberty of universities, and excepting the Chinese characteristic university regime of running the university by law, managing by self, supervising democratically and participating socially.
