摘 要:学位授予权是国家或国家授权的教育机构对具备一定学术水平或受教育水平的个人授予相应学位并颁发相应学位证书的法定权力,从法理层面来讲,享有学位授予权的高校是法律法规授权的行政组织,学位授予行为既是一种自由裁量行政行为,也是一种依申请行政行为,具有可诉性。但目前高校学士学位授予权的行使,存在学士学位授予缺乏可操作性标准、高校学士学位授予条件自我扩大了法律法规授权的边界、学士学位授予管理制度不完善等法律缺失现象。高校学士学位授予权的合法行使,必须从完善学士学位授予标准、加强学士学位授予的法律意识、强化学士学位授予的管理等方面着手。Degree awarding can be defined as a legal right issued either by the nation itself or certain entitled educational institutions to award someone who receives the corresponding education or meets the academic standards. The university entitled by the nation is simply an administrative organizational party in law. Therefore, it is possible to appeal such higher educational institutions given that degree awarding is not only a discretionary act in administration but an administrative act upon applications as well. Yet at present,the exercise does not follow this way mostly due to the lack of practical standards, the illegal extension of the laws and principles by universities themselves as well as the lack of effective laws on the administration of the degree awarding. In conclusion, a fair and legal practice of degree awarding must rely on the improvement of the current degree awarding criteria, the enforcement of legal consciousness on it and the emphasis of the administration.
