人民法院上下级关系异化问题研究

摘　　要：法院是社会不可或缺的减震器。我国上下级法院之间是审级监督关系,但在实践中法院上下级之间存在一定的异化现象,主要表现在法院系统行政化现象比较严重,业务领导关系变成上下级关系,这为行政干预司法提供了可能性,影响了法官独立审判,破坏了审级监督关系。应通过重视法院工作,切实加强领导;规范党对法院的领导;重构地方司法行政体制;创建新型的法官制度;逐步取消案件请示制度等措施来完善。The court is indispensable to social shock absorbers. Relation between different courts is case- hearing supervision between higher and lower courts in our country,but in practice,court dissimilation phenomenon between higher and lower,mainly manifests in the court system are seriously town government and business leaders relationship into a hierarchy,which provide the possibility for judicial administrative intervention,affect the independent trial,destroyes case- hearing level supervision relationship. Work should be given to improve it by paying attention to court,strengthening the leadership; regulate the leadership of the Party to the court by rule; to reconstruct the local judicial administrative system; create a new type of the judge system; and phasing out case management system,and other measures.
