指定居所监视居住的正当性考量

摘　　要：指定居所监视居住作为一种强制性措施,符合法律保留原则、法律明确原则的要求,并不必然导致侵害人权的发生,是充分协调惩罚犯罪与保障人权二者关系的合理产物。加之立法对其适用条件、适用场所的限制,能够在一定程度上避免指定居所监视居住的滥用,因而应当认定其具有正当性。但仍需加强执法队伍建设,增强法律规定的明确性,并与相关法律相衔接,以此保障并增强其正当性,确保刑事诉讼价值的实现。Assigned residence under surveillance is a kind of enforcement measures,which comforts to the principle of legal reservation and the principle of explicitness,and does not necessarily contribute to the infringement of human rights.It is the result of coordination between punishing the crime and protecting the human rights.Additionally,legislations have limited the applied conditions,implementing places of assigned residence under surveillance.Therefore,assigned residence under surveillance should be regarded as legitimacy,for it can partly avoid the abuse of this measure.It is also necessary for our country to strengthen the judicial group,enhance the legal clarity,coordinate with relevant regulation,which can preserve and promote the measures＇ legitimacy and the realization of criminal procedure＇s values.
