摘 要:节能减排是解决我国环境和资源问题的必然选择。行政强制措施是节能减排的一种重要保障措施,但还存在种类不够多样、非法设定和适用现象突出等问题。针对这些问题,应根据产生能源资源浪费和高碳排放的不同构成要素提出对策。在主体要素上,采用取缔组织实体和暂停或限制资格等;在行为要素上进行强制担保;在物的要素上则包括将限制能源资源的供给和使用的行政强制措施上升为法定种类、扩大冻结资金适用情形以及强制搬迁等。Energy saving and emission reduction is the inevitable choice to solve the problems of environment and resources in china.Administrative coercive measure is one of the important safeguard measures for energy conservation and emission reduction,but there are still many problems,such as monotonoustypes,illegal setting and application.Aiming at these problems,the countermeasures should be put forward according to the different components of the waste of energy resources and high carbon emissions:to banthe organization entity and to suspense or restrict the qualificationin subject level,to havemandatory guarantee in behavioral elements;to legalize the category,to expand the freezing of funds application situation and to force the relocation rather than to limit the supply and use of energy resources.
