摘　　要：犯罪心理测试技术已经广泛应用到了实践之中,并在侦查的各个阶段都发挥着重要的作用,与之不相称的是理论界对于测试结论的证据能力及法律地位却存在巨大争议。结合犯罪心理测试技术相关理论的梳理不难发现,心理测试结论具有证据能力,应归属于鉴定意见之下。应在完善技术自身的同时,制定行业规定,规范心理测试技术的应用,在立法上对心理测试结论证据能力予以确认,推动犯罪心理测试技术进入法制范畴,使心理测试结论的应用实现"线索型"向"证据型"的根本转变。Criminal psychological test technology has been widely applied to practice,and plays an important role in various stages of investigation,but there is a huge controversy over the evidence ability and legal status of its conclusion. Combined with the theory of criminal psychological test technology,it is not difficult to find out that the psychological test conclusion has the ability of evidence,and should belong to the identification opinion. It is necessary to perfect the technology,at the same time,formulate industry regulations,administrate the application of psychological test technology,confirm the evidence ability of psychological test conclusionin in legislation,promote the criminal psychological test technology into the legal category,and turn the application of psychological test conclusion from ＂type of clues＂ to ＂type of evidence＂.
