论区域协调发展法制化的逻辑起点

摘　　要：区域协调发展法制化需要明确逻辑起点,其实质也是明确区域发展权的范畴体系。区域协调发展法制化应以立体式的三位一体的人权法治观为切入点,以区域发展权为逻辑起点。区域协调发展法制化的逻辑起点分为主体、客体和空间三个维度。主体维度上应强调区域内主体之间的连带关系,着眼人与区域发展、社会发展之间的辩证统一关系;客体维度上应立足于人权,以区域发展的权利为落脚点;空间维度上应将区域发展中的人和区域紧密相连,强调区域内人的全面自由发展。Legalization of regional coordinated development needs to clear the logical start point,which also definite the category system of the regional development right. Legalization of coordinated regional development should be based on the tridimensional trinity concept of Human Rights as an entry point,which takes the right to regional development as the logical starting point. The logical starting point of coordinated regional development legal system is divided into three dimensions,which are subject,object and space dimensions. It should be emphasized the joint relationship between each subject in region,which focuses the dialectical unification relationship between people,regional development and social development. The object dimensions should always be based on human rights,which takes the rights of regional development as the purpose. On the spatial dimensions,people in regional development should be closely linked to the region. It should be emphasized on all- round free development about people.
