试论非营利性民办高校的两种基本属性——基于第三部门理论和公共组织理论视角

摘　　要：非营利性民办高校具有第三部门和公共组织两种属性。第三部门是指不属于第一部门和第二部门的所有组织部门的集合。公共组织是在特定历史时期形成和发展起来的一个以奉献和服务为宗旨的正式组织机构,包括政府与非营利性组织,其最大特点就是公共性,目的在于维护和实现整体利益。根据第三部门理论和公共组织理论的意涵可知,作为不以营利为目的、不计经济回报、履行政府部分公共职能的非营利性民办高校具有第三部门和公共组织属性,既属于第三部门,也属于公共组织。Non-profit private colleges have two attributes of third sector and public organizations. Third sector refers to the collection of all the departments which do not belong to the first and second sectors. Public organization is formed and developed into a formal organization with the purpose of dedication and service in the specific historical period, including the government and the nonprofit organization, the biggest characteristics of which is public, being aimed at safeguarding and realization of the interests of the whole. According to the theory of the third sector and the implications of public organization theory, we can know that non-profit private colleges which are not aimed at making profit, don＇t seek any economic returns and perform part of government public functions, have the properties of third sector and public organization and are alSO a public organization.
