摘 要:年休假权的法律性质应采二分权说中的选择债权说,在构成要件上,对"连续工作"区分三种情况予以分别认定;在休假日期安排上应解释为职工选择权;并对用人单位的给付拒绝权通过类型列举的方式予以严格限制;在未休年假救济上,双倍工资报酬性质为工资,适用特殊仲裁时效。此外,我国现行制度设计过于原则、复杂,未来可考虑增加部分期间带薪年休假制度、确立禁止假期赎买规则、简化构成要件、明确休假日期的确定和证明规则、统一休假基准以保障职工带薪年休假的权利。The legal nature of the right to annual leave shall be taken in the alternative fight for obligation, the Elements of continuous work should distinguish the three cases to be identified separately.
