我国数据库权利行使的正当性分析

摘　　要：目前,我国数据库权利是在著作权法、反不正当竞争法和合同法的框架下行使的。论文首先阐明我国数据库权利行使在法律这一正当性前提下进行,揭示其权利行使的自由和正义性都需要法律的保障,最后对依法保障我国数据库权利行使提出了几点建议。At present, the database right in China is exercised under the framework of the copyright law, anti-unfair competition law and contract law.This paper first states that the database right is exercised in the premise of law legitimacy,and then reveals that the freedom and justice of database right exercise should be supported and protected by the law. Finally,it puts forward some suggestions to ensure the database right exercise in accordance with the law.
