摘　　要：大学生在外兼职经常被当作廉价的劳动力,自身合法权益得不到保障。现行法律对大学生兼职现象并没有明确的界定,当前学界对于大学生是否属于劳动法的主体也还有争议。因此需要从法理上明确劳动法的主体特征,构建大学生兼职的劳动权益保护体系,加强各部门的协作力度,从而有效保护兼职大学生的合法权益。Nowadays college students with part - time jobs become a common phenomenon, and the infringement phenomenon has oc- curred frequently. Part - time college student is often cited as a cheap laborer. Their legal fights and interests cannot be guaranteed. The current law on college students ＇ part - time phenomenon has no clear definition. Whether college students belong to the labor law protection or not remains controversial in academic circles. College students need to be clarified labor law subject characteristics. Con- struction of college student part - time labor rights protection system, and strengthening the collaboration of all departments are necessa- ry. Thus effectively protecting the legal rights and interests of part - time college students.
