摘 要:构建与完善高校学生学术不端行为惩处制度是规范学术研究、重塑学术共同体学术责任伦理的内在旨意。通过以法律规范和政策规范的核心要素为分析标准对50所高校的惩处文本分析,发现高校制定的学生学术不端行为惩处制度存在功利化的价值观念有悖教育的整体目标、制度文本诸条目规范内容欠妥、制度文本完整性有待商榷等瑕疵,未能真正实现制度"善"与程序正义的学术善治愿景。为此,需要重塑惩处制度的价值观念、规范惩处制度文本内容以及建立惩处制度的问责制度来构建公平正义的高校学生学术不端行为惩处制度。Building and improving the system of college student punishment of academic misconduct are the inner purposes of regulating academic research and reshaping the academic responsibility ethics of academic community. Taking the core elements of legal norms and policy standards as analysis criteria, we analyzed 50 colleges' punishment texts and found several flaws. Contrary to the overall goal of education, utilitarian value orientation exists in the students' academic misconduct punishment system formulated by colleges and universities. The specification content of system text entries is defective and its integrity also needs to be inspected. Hence, it fails to realize the goodness of system and the justice of procedure authentically. Therefore, we need to weigh the value orientation of punishment system, standardize the text of students' academic misconduct punishment, and establish the accountability system of punishment system to build a fair and legal system of college students' academic misconduct punishment.
