摘 要:应诉管辖制度尊重当事人在确定管辖法院中的意愿,彰显当事人程序主体性,并最终服务于民事诉讼模式的转型。但是,受地方保护主义与部门本位主义的影响,具体适用规则供给严重不足的应诉管辖制度可能异化为某些法院争夺或推诿管辖权的工具。为争取案件在其诉讼成本较低或者可以动员更多司法干预资源的法院审理,某些原告故意向无管辖权法院提起诉讼,并促使应诉管辖制度的适用条件在外观上得以成就。为防止被受诉法院强制适用应诉管辖制度,逾期未提出管辖异议的理性被告不得不考虑采取不应诉策略。应诉管辖制度在司法实践中的运行结果与立法初衷背道而驰,亟需对其司法嬗变情形进行类型归纳和理论反思,并在解释论上构建促使应诉管辖制度回归推定合意管辖模式的规则体系。The litigation jurisdiction system respects the will of the parties of determining the court of jurisdiction, highlights their procedural subjectivity and finally services the transformation of civil litigation mode. However, as influenced by local protectionism and departmentalism, the litigation jurisdiction system with serious shortage of specific applicable rules may transmute itself into a tool for some courts to compete or shirk the jurisdiction. In order to make the case heard in the court that can save more litigation costs or mobilize more resources to intervene with judicial decisions, some plaintiffs deliberately lodge a complaint with the court which does not possess statutory jurisdiction and seek access to make it applicable for conditions of litigation jurisdiction system. And the defendants who fail to put forward the objection to jurisdiction have to consider the non-appearing in case of the ruling court's mandatory application of jurisdiction system. As the actual results of the litigation jurisdiction system run contrary to the legislative purpose, it is urgent to summarize and theoretically reflects on those judicial transmutation and build the system of rules compatible with presumed consensus jurisdiction model in terms of interpretative theory.
