全球治理时代我国法治发展的动力分析

摘　　要：全球治理时代的法治除具有传统法治的基本要素之外,还具有国际性和跨国性。当前法治包含国内、国际、跨国三个层面的含义;是动态的全球善治过程。就国内法治而言,不仅包括国际法规范,而且还具有国际标准。从法治的动力角度来讲,这是跨国因素和国际因素能够成为一国法治发展动力的前提条件和重要原因。而法治的跨国动力和国际动力主要是指国际组织、跨国间非政府组织、国家等通过采取披露法治状况,强制性或非强制传播法治能力、知识和信念,敦促一国加入国际公约或国际组织,相互间订立条约等方式促进一国法治发展的过程。就我国的法治发展而言,法治的动力应具有多元性,既包括人权的内驱动力、经济的全球化发展、中国共产党和新型动力主体的推动,又包括国际和跨国因素的促进等。The content of the rule of law in an era of global governance not only includes the basic elements with the traditional rule of law,but also has the new elements of international and transnational. The rule of law as a dynamic global govemance process has three meanings including the rule of law in domestic,transnational and international. Mainly for domestic,international,international law has three meanings. The rule of law,including not only the norms of international law,has the international standard also. This is the transnational and international factors can become a prerequisite for the development of the rule of law in a dynamic and important reason. The international and international dynamic of rule of law mainly refers to international organizations,transnational NGOs,other countries by taking the disclosure situation of the rule of law,mandatory or non mandatory disseminating the knowledge and belief propagation ability about the rule of law. In one condition,they persuade a state to join the international convention or international organizations. And in other condition,they make a treaty and other ways to promote the development of a country＇s rule of law. In China,the dynamics of rule of law should be derived from the domestic,international and transnational. They may be human right＇s needs,promotion of the development of economic globalization,the Chinese Communist Party and the new power of the subject,promotion of international and transnational facts.
