《大清律例》法律术语特征探析

摘　　要：法律其实就是语言的法律。法律语言的法律词汇系统主要由法律专门术语和法律专业词语有机组合而成。法律专门术语是生成法律文本语言整体系统的核心要件。《大清律例》数以千计的法律术语,展现的是清代法律语言文化的核心价值观念,一定程度上昭示了中国古代传统法律语言体系的整体性法律观念及清代法律语言文化的时代特征。《大清律例》法律语言障碍的分析和疏解,主要体现为对其法律术语外化符号表现特征的理解和阐释。从不同视阈考察《大清律例》法律术语符号体系,归纳总结其饱蘸中华法系独特性格特征的法律专门术语外化表现形态,揭示其存在的专属性汉民族传统法律术语文化精神的客观规律,是研究清代法律语言文化整体价值的必由之路。The law is law of words. More specifically, the law is much more than a collection of technical terms or other professional phrases. Legal term claims the core element in the entire system of legal language in a legal discourse. Thousands of legal terms conceived in the Qing Code are in fact incarnating the essential legal value of the cultural legal language on the one hand and in some sense is frankly declaring the holistic legal concept on the other while representing the characteristics typical of the cultural legal concurrently going on in the Qing Dynasty. Analyzing or interpreting the language language barriers existent in the Qing Code in most cases relies on analytical study or interpretation of the exteriorized semiotic presentation of the legal terms. The study of the holistic value concerning the Chinese legal language and culture in the Qing Dynasty may be the only way to exploring the symbolic system of the legal terms in the Qing Code from different perspectives, generalizing or summarizing the revealing the objective regularity of cultural legal spirit terms being pregnant of the Chinese legal genealogy and of the legal terms exclusive of the traditional Chinese nationality.
