“和谐人居梦”背景下预告登记效力的拓展思考——以房地产企业破产中购房人的利益保护为视角

摘　　要："和谐人居梦"的实现是"居者有其屋"的和谐社会建设的重要内容,也是实现中华民族伟大复兴的"中国梦"的重要环节。当房地产企业因经营不善陷入破产困境时,购房人的人居梦将面临破灭,这必将影响社会稳定。在这样的背景下,将《物权法》所规定之不动产预告登记的保全效力拓展至企业破产程序中,使得进行了预告登记的购房人能够继续推进本登记,进而取得房屋所有权,这有利于充分发挥预告登记之制度价值,保护购房人利益,促进和谐人居梦化为现实。The realization of harmonious housing dream is an important content in the construction of the Harmonious Society, but also an important link in the ＂ China Dream＂ of the great rejuvenation of the Chinese Nation. If the real estate companies fall into the bankruptcy procedure because of poor management, the harmonious housing dreams of the house buyers will bust. At the same time, the securing validity of the forenotice registration provided in the Property Law of China should go on in bankruptcy procedure. The rights holder should have the rights to carry on the registration to gain the real property. So it is helpful to take advantage of the value of the forenotice registration, protect the interests of the house buyers and realize the harmonious housing dream.
