摘 要:随着侵权责任法的实施,提供劳务者受害责任替代雇员受害责任成为司法实践中新的立案案由。个人之间的提供劳务者受害责任归责原则为过错责任原则,应严格把握过错责任内容、举证责任承担与分配、双方过错衡平。个人与用人单位之间的提供劳务者受害责任不适用侵权责任法第35条规定,仍应坚持无过错责任原则。个人向单位提供临时性劳务、退休返聘、大学生实习兼职等常见情形,实践中对于该类劳务关系的争议主要集中于劳务或劳动关系的识别问题。With the implementation of tort liability law, instead of employee victim liability, labor service supplier victim liability becomes a new case-filing in re. The doctrine of liability fixation for labor service supplier victim liability among individuals is doctrine of liability for fault, which means strictly grasping the contents of fault liability, underlaking and assigning burden of evidence, and counterpoising faults for both sides. The labor service supplier victim liability between individual and employing unit is not applicable to Article 35 in "Tort Liability Act" , which still should adhere to the principle of liability without fault. In practice, when facing such kind of common situations, like individual providing temporarT labor service to units, retirement employment and college students' part-time and internship job and so on, the arguments mainly focus on indentifying issues of service or labor relations.
