摘 要:责任,至少可分为"义务"和"课责"两种类型,体现为"显见责任"和"隐含责任"两种存在形态。在食品安全社会共治的诸主体中,食品生产经营者和政府监管者承担的法律责任都是显见责任,涵盖了多种法律义务和法律课责。而社会其他主体在承担少量显见责任的同时,还承担着一些隐含责任。这些法律责任共同构成了以政府监管为中心、主体责任和监管责任为重点、其他制度性责任相协同的食品安全责任共治结构。Responsibility at least can be divided into two types of 'duty' and 'accountability', as well as two existing forms of 'evident responsibility' and 'implied responsibility'. Among subjects of food safety social co-governance, the legal responsibility taken by food producers and government regulators belongs to evident responsibility, covering many kinds of legal duty and accountability. Meanwhile, other social subjects carry little evident responsibility as well as some implied responsibility at the same time. All the above legal responsibility consist the food safety responsibility co-governance structure, i.e. government regulation being as the core, subject responsibility and regulation responsibility being as the focus, and other institutional responsibility being as the synergy.
