立法语言中指人“的”字结构探析——以《刑法》为例

摘　　要：指人"的"字结构是我国立法语言中使用频率很高的句法形式之一。从语法、语义、语用三个方面来看,立法语言中的指人"的"字结构在承载较大的语义信息量的同时更好地体现了立法语言庄重性、准确性、严谨性和简约性的特点,准确地加以使用有助于明确犯罪对象,从而对特定人群的违法犯罪行为予以法律约束和处罚。＂De＂ structure of referring to man is one of the most frequently used syntactic form in Chinese legislative language. From three aspects of syntax, semantics and pragmatics, ＂de＂ structure of referring to manin legislative language carries the large amount of semantic information,and also better reflects solemn, accurate, rigorous and simple characteristics of the legislative language. If used accurately, it will help to make clear the object of the crime, so as to give legal restrictions and penalties of illegal criminal acts in the specific crowd.
