摘 要:土地征收制度与土地储备制度之间具有高度的关联性,土地征收制度实际上成为土地储备机构取得储备土地的主要手段。缩小征地范围后,土地储备的立法应当继续强化并明确土地储备制度的公共利益实现功能,并明确将土地储备机构定位为以实现公共利益为目的的公法法人或者私法法人。缩小征地范围后,土地储备的范围应当包括存量国有建设用地、存量集体建设用地以及部分新增的集体建设用地。在储备土地的获得方面,立法需要明确土地储备机构代表国家通过收购与行使优先购买权方式获得建设用地的具体程序与规则,并将基于公共利益需要的国有土地使用权收回与集体土地征收作为储备土地获得的最后保障。Land requisition system and land reserve system is highly connected. In fact, land requisition system has already become the main means of obtaining land for land reserve institution. After narrowing the scope of land requisition, we should continue to strengthen the function of public interest in land reserve system, and land reserve agencies should be defined as legal persons for the purpose of achieving the public interest. Then, land reserve scope shall be included the stock of state - owned construction land, the collective construction land, and some of the new stock of collective construction land. In terms of reserve land acquisition, land reserve agencies can obtain lands by buying and exercising preemptive rights on behalf of the state. Basing on public interests, land reserve agencies can obtain lands through the process of expropriation.
