增设袭警罪问题研究

摘　　要：袭警是近年来常见多发的一种社会事件。随着互联网和自媒体的迅速发展,公众对袭警问题的关注度越来越高,袭警现象也引发了人们更多的思考。袭警事件频繁出现,袭警手段变化多样,不仅使国家公权力受到挑战,国家安全面临威胁,社会秩序受到干扰,对于执法警察的生命威胁也不容小觑。和其他国家立法相比,中国刑法对警察权益的保护力度尚显微弱,打击力度也不够。增设袭警罪,完善刑事立法,对有效遏制袭警行为具有重要意义。Assaulting policeman is a common social phenomenon in recent years. With the rapid development of Internet and we-media, more attention has been paid to the issue of assaulting police- man by the public, and the assaulting phenomenon has also caused more thinking from people. With frequent attacks on police, and more ways in assaulting, not only the state＇s public power is openly challenged, national security threatened, social order disturbed, but also the threat to the life of law enforcement policemen is not to he overlooked. Compared with other national legislation, China＇s criminal law in protection of police＇s rights is still quite weak, and the strike force to the criminals is not enough. Therefore, it is of great significance to add the crime of assaulting policeman so as to improve the criminal legislation and efficiently check the act of assaulting policeman.
