当代中国民事纠纷解决方式的选择——基于CGSS2005的法社会学分析

摘　　要：本文利用2005中国综合社会调查数据(CGSS2005),建立以"社会背景特征和社会群体特征"为自变量与以"非诉讼方式与司法诉讼"为因变量的Logistic回归分析模型,证实了社会群体特征在感性选择机制作用下与行为选择发生因果关联,社会背景特征在合法性认同机制作用下与行为选择发生因果关联。研究表明,在民事纠纷中,教育程度越低、收入水平越低、社会交往因子值越低的人越有可能选择非诉讼方式;较之城市,农村居民更可能选择非诉讼方式;较之西北地区,西南、中南和华东地区居民更可能选择非诉讼方式。"感性选择机制"更可能解释当代中国普通民众的行为选择。在此基础上,文章进一步讨论了转型期"非诉讼方式"与"司法诉讼"的关系结构在中国法律发展中的意义,并认为现代法治建设应当在本土话语的框架下谨慎行进。This paper studies the relations between social characteristics and the approach of nonlitigation or litigation,through statistical analysis of Chinese General Social Survey 2005( CGSS2005)by setting 'social-group characteristics ' and 'social-background characteristics ' as independent variables and 'whether to adopt litigation'as a dependent variable. The result of this logistic regression model demonstrates that the approach choice is significantly influenced by the social-group characteristics under the mechanism of perceptual choice,and the choice is significantly influenced by the social-background characteristics under the recognition mechanism. The conclusion is that it is more possible for people with lower level of education, less income and lower frequency of social communication to choose the approach of non-litigation. And it is more possible for the rural people to choose the approach of non-litigation than the urban people. In addition,it is more possible for people from the Southern-West,the Central-South and the East China to adopt non-litigation than those from the Northern-West China. All in all,in China,'Mechanism of Perceptual choice'is more persuasive in explaining people's approach in the Civil Dispute.
