摘　　要：作为强制性国际规范条约,《经济、社会文化权利国际公约》第一次以国际法律形式对工作权、工会权等经社权加以确认。我国于2001批准该公约后,公约已经成为我国推动与保障外国人就业权的国际标准。公约要求成员国在履行法律义务时,尊重外国人就业权,明确相应的国家义务与相关措施,根据本国国情,保证该项义务的切实履行。相比公约的要求,我国对外国人在华就业管理上存在着缺乏统一的法律制度、统一的执法机构、完善的司法救济手段、有效的行动措施以及广泛的国际合作等问题,为此,文章提出了认真履行公约义务、坚持发展中国家地位、以整体系统的观念,通过健全法律制度、统一执法机构、提供司法救济以及广泛开展国际合作等途径有效管理和保护外国劳动者。As a mandatory international normative treaty, The International Covenant on Economic, Social and Cultural Rights（ICESCR） recognizes the right to work, right to trade union and other economic rights in international legal form for the first time. China ratified the Convention in 2001, the Convention has become the international standard for China to promote and protect the right to employment of foreigners. The Convention requires member states to respect the right to employment of foreigners in the course of fulfilling their legal obligations, and to clarify the corresponding state obligations and relevant measures and ensure the effective performance of such obligations in accordance with their respective national conditions. Compared with the requirements of the Convention, there aren＇t unified legal system, unified law enforcement agencies, perfect judicial remedies, effective action measures and extensive international cooperation on the employment management of foreigners in China. Therefore, the author puts forward the concept of conscientiously fulfilling the obligations of the Convention, upholding the status of developing country, and effectively managing and protecting foreign workers through a sound system, a sound legal system, unified law enforcement agencies, judicial relief and extensive international cooperation.
