摘　　要：检察权由诸多不同类型的权力组合而成,并各自在刑事诉讼流程中扮演着不可或缺的角色。目前的检察权配置,正是基于其权能的特质才形成固有模式,表现为精细化分工的内设机构。但是,这样的格局形态却导致司法实践中的权力运行障碍,限制了立法原意的实现,产生了某种"自缚性"。这一问题的解决,有赖于释放办案主体的自主性,以渐进方式破除"部门析出"的体制性障碍。当检察权以相对集中的样态呈现时,或许可以彻底摆脱因其自身功能失灵所造成的反噬,确保内外关系秩序的恢复。为此,需要重新对检察机关的内部组织形式进行排列组合,打破精细化分工的固有格局,代之以具有自主性的办案单元。当然,消除"自缚性"将是一个漫长的过程,科学的方法论在其中发挥着至为关键的作用,并推动提升司法效能、保障司法公正之根本目标的实现。The procuratorial power is a combination of many different types of powers, each of them playing an indispensable role in its respective criminal proceedings. The current configuration of procuratorial power in China is an intrinsic mode based on the special characteristics of various procuratorial powers and is manifested in the fine division of labor among various internal organs. However, such a pattern has impeded the exercise of procuratorial power in judicial practice, obstructed the realization of legislative purpose, and resulted in a kind of ＂self-bondage＂. In order to solve this problem, China should give full play to the autonomy of case handling organs, and gradually overcome the institutional obstacle of ＂departmental separation＂. Perhaps the procuratorial authority manifested in a relative concentrated form could avoid the problem resulting from its own malfunction and ensure the restoration of order in its internal and external relations. For this purpose, it is necessary to rearrange the internal organs of procuratorates, so as to break the existing pattern of fine division of labor and replace it with a new pattern that gives full play to the autonomy of case-handling units. Of course, breaking away from self-bondage will be a long process, in which scientific methodology will play a key role in achieving the goals of judicial efficiency and justice.
