摘　　要：以案件责任制改革为重点,以还权于合议庭为目标的我国民事合议制度内部关系的改革面临旧有痼疾尚未祛除和因错案追究制、审判长制的不当推行引发的新问题两种窘态。导致问题出现的原因一方面缘于合议制及改革措施存在缺陷,另一方面也因为改革受到现阶段审判资源不足、司法独立的大环境尚未形成以及相关配套制度不完善等因素的制约。为顺利推进改革,应从合议制的内部关系的梳理出发,合理定位合议庭成员之间的关系,理性选择案件责任制,完善合议庭的评议规则和表决规则。To make the collegiate bench system fully functional the reformation of collegiate bench system which leads by the Supreme Peopled Court in recent years choose accountability system of judge as the focus, and aims to urge collegiate bench perform its responsibility independently ,also improve the quality and efficiency of judgment. However, the reformation hasn’t realized its goal, but brings new problem to the collegiate bench system. The reason why the reformation failed is complicated, one is that the countermeasures are inappropriate, and the other is that the relative system is faultiness and we lack the environment that respecting the independence of judicature. To perfect the collegiate bench system, We should differentiate the administration from jurisdiction. We should allocate our resource properly, and perfected the regulation of collegiate bench.
