摘 要:确定可商业化利用的人格权益的范围是人格权商业化利用法律制度的重要组成部分,也是相关人格权商业化利用法律规则的前提和基础。为了扩大个人的自由,应当尽量扩大可商业化利用的人格权益的范围,就正面列举模式与反面排除模式而言,应当选择反面排除模式,即明确排除无法进行商业化利用的人格权益,除此之外的人格权益原则上都可以进行商业化利用。同时,为保护个人的人格尊严,防止人格权的过度商业化利用,原则上应当禁止物质性人格权的商业化利用行为。Determining the range of the commercially viable personality rights and interests is animportant part of the commercial appropriation of personality rights,which is also the premise and basis of some rules of the commercial appropriation of personality rights. In order to expand individual freedom,we should maximize the range of commercially viable personality rights and interests.On the positive list mode and reverse exclusion mode, we should choose the reverse exclusion mode,that is to explicitly exclude the personality rights and interests which can not be put into commercial appropriation,and the additional personality rights and interests in commercial viable. At the same time,in order to protect human dignity and to prevent excessive commercial use,material personality rights should be prohibited from commercial appropriation.
