摘　　要：学前教育是基础教育的重要组成部分,随着我国教育事业的发展,学前教育越来越受到社会的关注,同时也暴露出很多问题,要解决这些问题,就必须通过颁布一部学前教育基本法,改变我国高位阶学前教育法律长期缺失的状况,为学前教育事业发展提供全方位、高位阶的法律制度保障。应立法明确学前教育的法律地位和社会属性;强化政府的行政管理;明确幼儿园办园标准,严格执行资格准入制度;立法保障幼儿教师的权益;立法加强民办学前教育机构的监管,使学前教育的办学行为做到有法可依、有法必依、依法治教,使我们的学前教育事业步入良性发展之路。Preschool education is an important part of basic education. With the development of our education, preschool education gains more and more attention from the society, but a series of problems are also exposed, such as the difficulties of getting into a kindergarten, the high prices of kindergartens and high rate of accidents. To solve these problems, we must start from perfecting the pre-school education policies and regulations. Make clear the status of preschool education laws, the duty of the government from the aspect of law; formulate standards for all aspects of preschool education, implement the investment and security system I preschool education, and therefore protecting the rights of teacher and children in kindergarten with related laws. Only in this way can we guarantee that the running of kindergarten is to the law, by the law, and thus lead our preschool education into the road of healthy development.
