摘  要:备受关注的医师多点执业政策自实施以来,一直受到来自人事管理、法律风险、社保衔接等多方面的阻力。因此,在改革的过渡期,如何以合同来平衡各方利益、防控法律风险已成为该政策推行的必由之路。医师多点执业聘用协议的性质应当定性为劳动协议,鉴于这种医疗服务具有特定的法律风险,其聘用协议的内容应当包括强制性的必备条款和倡导性的任意条款两部分。前者包括缔约双方的信息、工作时间、地点、期限及内容、工伤保险、劳动保护、劳动条件和职业危害防护、工作报酬及支付方式条款,后者包括医疗责任保险、不正当竞争防范、职务发明创造及职务作品的归属、违约责任和医疗损害责任分担条款。The implementation of physicians ' multi-site practice policy has been obstructed from personnel management, le- gal risk and social security convergence. Therefore, during the transitional period of reform, how to balance the interests of all par- ticipants and control legal risk by contracts has become the only way for its implementation. The legal essence of employment a- greement of physician multi-site practice should be classified as labor agreements, which should contain necessary mandatory terms and advocating arbitrary provisions. The former includes basic information of the parties, working time, address, content, work place, duration, work injury insurance, labor protection, working conditions and protection against occupational hazards, remuneration for work and terms of payment. The latter includes medical liability insurance, prevention on unfair competition, ownership of job-invention and job-related works, violations liability of contract and medical damage liability sharing provisions.
