摘  要:现代社会食品安全的频发是风险社会在食品领域的典型表现。由于风险社会下食品安全风险的持续化和扩大化、人们对食品安全的特别要求,以及预防性为主的传统刑法规制不足以有效保证食品安全等问题的存在,必须通过扩大食品安全刑法的调整范围、注重恢复性刑法规范,以及坚持谦抑性原则等方式,促成风险社会下中国食品安全刑法规制的顺利转型,更好地达成保证食品安全的法律目的。The frequent occurrence of food safety in modern society is the typical performance of risk society in the field of food. Under the risk society, due to the ongoing and expansion of food safety risk, people's special requirements for food safety, as well as prevention based traditional criminal law regulation is insufficient to ensure the food safety, the measures must be done, for expanding the food safety law adjustment range, paying attention to the restoration norms of criminal law and adhereing to the principle of modesty etc.. All these can contribute to the smooth transition of China's food safety regula tion of criminal law in risk society, to achieve the purpose of law to ensure food safety.
