摘　　要：本文介绍了一起未取得兽药经营许可证网上经营兽药的案件。执法人员依据《兽药管理条例》有关条款,对当事人进行了没收违法所得、处货值5倍罚款等处罚。该案涉及70多个地市,涉案范围广,违法行为情节较重。本案的查处提示:在查明兽药网上非法经营案件时,要注重电子证据的收集与固定;网络经营涉案地区点多面广,要按照《农业行政处罚程序》的规定,以发送协查函的形式协查案情,形成完整的证据链;执法人员应当严格执法,充分重视两法衔接的重要性,为打击违法犯罪,规范兽药经营行为,保障畜牧业健康发展和维护公共卫生安全奠定基础。In this article, a case of selling veterinary drugs online without business license was introduced. According to the relevant provisions of the Regulations on Administration of Veterinary Drugs, penalties including confiscation of illegal gains and a fine of five times of the cargo value were conducted towards the parties by the law enforcement personnel. Being a serious violation, the ease involved more than 70 cities, and covered a wide range of impact areas. Based on the investigation, it was indicated that when it came to handling such cases of illegal business, close attention should be paid to the collection and fixation of electronic evidence. Meanwhile, due to the wide range of the areas involved in network business, assistant investigation of such cases should be initiated according to the Procedural Provisions on Agricultural Administrative Punishments in the form of issuing letters of assistant investigation, so as to form an integral chain of evidence. Besides, relevant officials should enforce the law strictly and give full attention to the importance of linking judicial enforcement with administrative enforcement. At the end, firm foundation will be laid for cracking down illegal crimes, regularizing behavior of veterinary drug management, ensuring the healthy development of animal husbandry industry, as well as ensuring the public health security.
