摘 要:2016年2月4日,TPP协定由12个成员国正式签署,目前正处于批准阶段。TPP劳工标准的最大特征是具有可强制执行力,适用磋商基础上的强制性争端解决机制,以贸易制裁或经济制裁为后盾,这意味着任何劳工争端最终都会延伸为贸易纠纷问题。虽然中国尚未加入TPP,但TPP劳工标准实施后的扩大适用给我国带来的负面影响应引起我国高度重视并应分别在微观、中观和宏观层面上采取应对措施,以防患于未然、更好地保护我国经济和贸易利益。On February 4,2016,TPP agreement was signed by the 12 member states and now is under formal approval process. The most outstanding characteristic of TPP is its enforceable labour standards, which require labour disputes subject to dispute settlement of the TPP Agreement if consuhation failed within the prescribed period. This implies that any labour dispute will eventual- ly be connected with trade issue. Although China has not joined TPP, extended application of TPP labour standards after the TPP coming into force will inevitably bring about negative impacts to non -TPP states such as China. Thus China should attach close attention to these forthcoming po- tential negative impacts and take countermeasures respectively at micro, meso and macro levels with an aim to better protect China~ economic interests in its foreign trade and investment.
