证据裁判原则下完善公安机关刑事证据审查机制的思考

摘　　要：以审判为中心的刑事诉讼制度改革更加强调证据裁判和直接言词原则,对侦查取证质量提出更高要求。公安机关近年来发现、获取、解读刑事证据的能力逐渐提高,取证的规范化程度也有较大提升,但还存在不少问题。公安机关应将刑事案件的证据审查纳入执法管理范畴,尽快制定、完善刑事证据收集工作指引,建立以办案部门主责的证据审查责任制,充分发挥法制、预审部门的职能作用,建立新型侦检关系和侦辩关系,从执法源头和办案过程的不同环节强化证据审查,及时发现问题,解决问题,确保用作定案根据的证据具有证据能力和证明力,有效提升刑事办案质量。The criminal procedure reform, based on judgment, places more emphasis on evidence judgment and the prin- ciple of Directness and Verbalism. And it set a still higher demand on the quality of investigation evidence. Recently, the abilities of public security organization to discove, obtain and understand the investigation evidence improved grad- ually. The standardization of obtaining evidence has improved as well. But still there are some problems. The public se- curity organization should put the evidence investigation of criminal cases into law enforcement management category. Also, the public security organization should establish and improve criminal evidence collection work instructions as fast as possible. We should establish the review of evidence system of pre-trial department, and establish new detection responsibility system, give full play to the functions of legal and inspection relations and investigation contend relation- ship. Meanwhile, we should strengthen the evidence review from law enforcement source and the handling process of different links. In the end, the public security organization should timely detect problems and solve the problems to en- sure the evidences have the credibility. By doing these, the quality to handle the criminal case can be greatly enhanced.
