摘　　要：大学生兼职行为日益普遍,而关于大学生劳动者主体资格的认定尚未有实质进展,从而引发大学生权益保护的法律问题。从《劳动法》角度探讨了劳动者主体资格的相关法律内涵,认为从事兼职行为的大学生有双重身份:既是在校学生又具备劳动者的资格要素,应该享有劳动者的基本权利。Doing part-time job of college students is a common phenomenon. There is no substantive pro-gress on the determination of the subject qualification of the laborers ？ which leads to the legal problems of the protection of the rights and interests of college students. From the perspective of Labor Lazv ＇ the pa-per discusses the relevant legal connotation of the subject qualification of the laborers,and thinks that part-time college students have dual identities of both students and laborers,and should have the basic rights of laborers.
