摘　　要：大学章程建设是高校依法治校、科学发展以及完善中国特色现代大学制度的重要环节。在大学章程的实施和后续建设中,对大学章程内在精神的思考、凝练、建构和倡扬不可忽视,它将对大学章程完善乃至现代大学制度建设起到重要的价值导向、目标整合、凝聚力量和思想动员作用。大学章程的精神建构必须置于现代大学治理体系的背景中去加以认识。其中,学术自由精神是现代大学治理的核心,民主共治精神是现代大学治理的实质,依法治校精神是现代大学治理的基础,责任伦理精神是现代大学治理的归宿。The formulation of university statutes is an important link of governance by law, scientific development, and improvement of modern university system with Chinese characteristics for universities. In the implementation and follow-up development of university statutes, the thinking, condensation, construction, and advocacy of the inherent spirits of university statutes cannot be ignored. They will play important roles in terms of value orientation, goal integration, force cohesion and ideological mobilization for the improvement of university statutes and the establishment of modern university system. The spiritual construction of university statutes must be understood in the context of modern university governance system. The spirit of academic freedom is the core of modern university governance. The spirit of democratic shared governance is the essence of modern university governance. The spirit of governance by law is the basis of modern university governance. The spirit of ethics and responsibility is the ultimate destination of modern university governance.
